Complying with FERPA Requirements for Maintaining and Sharing Information about Students

The Family Educational Rights and Privacy Act (FERPA) provides protections for student records and impose a number of obligations on school entities in terms of when it may and must share certain information. Since FERPA was passed though, technology and new issues have developed that were not considered when the law was passed, but nonetheless must be addressed by school entities. Some of these issues have been highlighted by recent court guidance on FERPA, including issues such as immigration issues, security breaches, and publicity issues, just to name a few. This session by expert speaker Timothy E. Gilsbach, Esq. will involve a review of those issues and some practical guidance on how to address each issue while complying with FERPA.

You will gain an understanding of FERPA and various issues around it that have been highlighted in recent court cases. Such issues include immigration, how to respond to publicity when it raises student privacy implications, the effect of FERPA in discipline matters and FERPA implications in employment. In addition, Timothy will review practical steps that school entities can take in addressing each of these issues.
