Critical Points to Consider in Conducting a Harassment Investigation

In order to determine the authenticity of a sexual harassment or other protected class harassments complaints, you need to have harassment investigation in colleges and institutions. It reduces the liability of the institution and averts the misconduct from being actionable and pervasive, which minimizes damages given to the complainant. An institutions dedication and commitment for the intervention and prevention of the misconduct is demonstrated by a well conducted investigation which reduces harassment on campus. The institution by having its own investigation also prevents an investigation from another agency like the U.S. Department of Education Office for Civil Rights. A proper, timely investigation helps in ensuring a healthy and safe campus for staff, students and faculty.

Although, having an harassment investigation in colleges for the sake of it, without knowing the science and art of the process is not good enough. In order to gain confidence of external agencies or the Court, the institution needs to demonstrate its commitment to preventing harassment and prove that their investigators are trained and have the necessary skills. In various “bullying” and harassment lawsuits, the absence of a competent investigation or no investigation at all has been a big risk factor for the university or school’s liability.
